Federal Judge Blocks Trump's Transgender Military Ban


On Tuesday, Federal Judge Ana Reyes halted President Donald Trump's executive order prohibiting transgender individuals from serving in the military.

In response, the Department of Defense (DOD) told Newsweek via email: "As a matter of policy, the Department does not comment on ongoing litigation."

Since his inauguration, President Trump has issued multiple executive orders aimed at rolling back rights for transgender individuals.

A week into his second term, he signed an order banning openly transgender people from military service, arguing that their presence undermines "excellence" and "readiness." Secretary of Defense Pete Hegseth later issued a memo affirming that transgender individuals would no longer be allowed to enlist, though those already serving with gender dysphoria would be "treated with dignity and respect."

Last month, the DOD also requested that transgender service members be identified and discharged.

The Court's Ruling

Judge Reyes determined that Trump's policy likely violates the constitutional rights of transgender troops. She temporarily delayed enforcement of her ruling for three days to allow the administration time to appeal.

In her decision, Reyes wrote:

"The cruel irony is that thousands of transgender service members have sacrificed—some even risking their lives—to protect the very equal rights that this ban seeks to strip away. Defendants have not demonstrated they will be burdened by maintaining the current policy during litigation, and upholding constitutional rights is always in the public interest."

She acknowledged the likelihood of heated debate and appeals following her ruling but emphasized that every service member deserves gratitude and respect. Citing journalist Elmer Davis, she concluded:

"This nation will remain the land of the free only so long as it is the home of the brave."

Reactions

Charlotte Clymer, a U.S. Army veteran, shared her thoughts on X (formerly Twitter), writing:

"This is far from over, but I'm gonna take some time tonight to enjoy the good news. 'U.S. District Judge Ana Reyes in Washington, D.C., ruled that Trump's order to exclude transgender troops from military service likely violates their constitutional rights.'"

The Trump administration now has the opportunity to appeal before the ruling takes effect.
